Constitutional Law Keyed to Choper
Pruneyard Shopping Center v. Robins
Citation:
447 U.S. 74 (1980)Facts
PruneYard Shopping Center was a privately owned shopping complex covering approximately 21 acres in Campbell, California, with 5 acres devoted to parking and 16 acres occupied by walkways, plazas, and buildings containing more than 65 specialty shops, 10 restaurants, and a movie theater. The center was open to the public for commercial purposes but maintained a policy prohibiting any visitor or tenant from engaging in publicly expressive activity not directly related to its commercial purposes. The appellees, high school students, set up a card table in a corner of the shopping center’s central courtyard to solicit signatures for petitions opposing a United Nations resolution against “Zionism.” Their activity was peaceful and orderly, and there was no evidence that patrons objected. When security informed them they were violating PruneYard regulations, they immediately left but later filed a lawsuit seeking an injunction to allow them access to the shopping center for petition-gathering purposes.
