The defendant insurance company sent a letter to the plaintiff proposing to renew his insurance policy unless the plaintiff notified them to the contrary. The plaintiff did not respond to this letter, nor did he pay any premium for the proposed renewal. The plaintiff later claimed that he had mentally determined to accept the offer but did not communicate this acceptance to the defendant. When the plaintiff’s property was subsequently destroyed by fire, he sought to enforce the insurance coverage based on the defendant’s letter, arguing that the defendant’s offer and his silent acceptance created a binding contract, or alternatively, that the defendant should be estopped from denying coverage because the plaintiff relied on the letter.
