Facts
Plaintiff Prah owned a residence that had a solar system, which included solar collectors on the roof. Defendant Maretti bought the lot adjacent to Plaintiff’s lot and planned to construct a house. Plaintiff advised Defendant that if Defendant’s house were built at the proposed site, it would cast a shadow on Plaintiff’s solar collectors, reducing the efficiency of the system. Plaintiff requested that Defendant locate his house an additional several feed away from Plaintiff’s lot line. Defendant went ahead with the construction before he and Plaintiff reached an agreement on the location of Defendant’s house. Plaintiff brought an action to court, demanding judgment for injunctive relief and damages.
