Adam Clayton Powell, Jr. was elected to represent New York’s 18th Congressional District in the 90th Congress. Prior to this, a House committee had investigated Powell’s expenditures as chairman of the Committee on Education and Labor during the 89th Congress and found evidence that he had deceived House authorities regarding travel expenses and made illegal salary payments to his wife. When the 90th Congress convened in January 1967, Powell was asked to step aside while other members were sworn in. The House created a Select Committee to determine Powell’s eligibility. Although the committee found that Powell met all constitutional qualifications (age, citizenship, and residency), it recommended that he be seated but censured, fined, and stripped of seniority. The House rejected this recommendation and instead passed a resolution excluding Powell entirely. Powell and some of his constituents filed suit against House officials, challenging his exclusion as unconstitutional.
