Plaintiff, Ms. Posecai, was robbed at gunpoint in Defendant Sam’s Club’s parking lot. The robbery occurred in daylight, and Plaintiff was robbed of two expensive pieces of jewelry worth upwards of $19,000. At the time of the robbery, Defendant, Sam’s Club, had a security officer stationed within the store. Plaintiff reported the crime to the police, and they never caught the assailant or recovered the Plaintiff’s jewelry. In preparation for trial, Plaintiff looked into how much crime occurred in the area. There had only been three robberies on Sam’s Clubs property for the six years prior to the Plaintiff’s incident. However, there had been eighty-three predatory offenses on the same block. Plaintiff sues for negligence.
