The defendant was married to her husband in 1948. In 1963, they purchased a home as joint tenants with a right of survivorship. In 1976, the defendant and her husband divorced. The divorce decree stated that the plaintiff had the right to “exclusive occupancy” of the house until “a change in the circumstances warrants a modification of this decree in this respect.” Sometime after the divorce, the husband remarried to the plaintiff and stayed with her until his death in 1983. There was later a dispute on who had what interest in the house that was purchased in 1963.
