Both the plaintiff and defendant attended a baseball game where Barry Bonds was expected to break the single-season home run record for home runs. When Barry Bonds hit the home run into the stands, the plaintiff was able to temporarily catch it with his glove. However, at this very moment, a crowd of other patrons engulfed the plaintiff, resulting in the plaintiff being thrown to the ground. At some point, the ball left the plaintiff’s glove and ended up on the ground where it was scooped up by the defendant. The specific moment when the plaintiff lost the ball could not be determined.
