In 1988 and 1989, Pennsylvania amended its Abortion Control Act of 1982, adding several provisions: (1) a requirement that a woman seeking an abortion give her informed consent after receiving certain information 24 hours before the procedure; (2) a requirement that minors obtain parental consent with a judicial bypass option; (3) a requirement that married women notify their husbands of their intent to have an abortion; (4) a medical emergency exception to these requirements; and (5) reporting requirements for facilities providing abortion services. Before these provisions took effect, five abortion clinics and a physician filed suit challenging their constitutionality. The case ultimately reached the Supreme Court, which had to determine whether these provisions were constitutional and whether Roe v. Wade should be reaffirmed or overruled.
