Planned Parenthood Golden Gate v. Superior Court
Citation:
83 Cal. APp. 4th 347, 99 Cal. Rptr. 2d 627 (2000)Facts
Planned Parenthood Golden Gate operates reproductive health clinics in San Mateo, Menlo Park, and Redwood City where anti-abortion protesters Rossi Foti and Jeannette Garibaldi regularly engage in picketing, leafleting, and counseling activities. Foti filed suit alleging that Planned Parenthood escorts physically obstructed and interfered with his constitutional rights, while Planned Parenthood cross-complained alleging that the protesters habitually harassed and intimidated employees, volunteers, and patients. During discovery, Foti and Garibaldi sought the names, residential addresses, and telephone numbers of non-party Planned Parenthood staff and volunteers who had knowledge relevant to the litigation. Planned Parenthood objected on grounds that disclosure would violate these individuals’ constitutional rights to privacy and freedom of association, and would subject them to potential harassment, intimidation, and violence. The record contained evidence of the “Nuremberg Files” website, which collected personal information about abortion providers and their associates, and evidence that some of the real parties’ attorneys had previously engaged in residential protests at clinic workers’ homes.
