Pittsburgh Press Co. v. Pittsburgh Commission on Human Relations
Citation:
413 U.S. 376 (1973)Facts
The Pittsburgh Press organized its employment advertisements under column headings designated “Jobs—Male Interest,” “Jobs—Female Interest,” and “Male-Female.” The newspaper allowed advertisers to select which column their advertisements would appear in, and when advertisers did not specify, the newspaper would ask whether they wanted male or female applicants and place the ad accordingly. The newspaper included a disclaimer stating the column organization was “for the convenience of readers” and that advertisers would consider applicants of either sex in compliance with anti-discrimination laws. In 1969, NOW filed a complaint alleging that the Pittsburgh Press violated the city’s Human Relations Ordinance by aiding employers in discriminating based on sex. The Commission found that the newspaper’s practice of maintaining sex-segregated columns aided employers in illegal sex discrimination and ordered the newspaper to cease this practice. After appeals, the Commonwealth Court modified the order to allow sex-designated columns only for jobs exempt from the Ordinance’s anti-discrimination provisions.
