In 1976, a small commercial aircraft crashed in the Scottish Highlands during a charter flight, killing all five passengers and the pilot. All victims were Scottish citizens and residents. The aircraft, a Piper Aztec, was manufactured in Pennsylvania by Piper Aircraft, while its propellers were manufactured in Ohio by Hartzell Propeller. The aircraft was owned and operated by a Scottish air taxi service. Gaynell Reyno, a legal secretary at the law firm representing the victims’ families, was appointed administratrix of the estates and filed wrongful death actions in California. The cases were transferred to Pennsylvania, where defendants moved for dismissal on forum non conveniens grounds, arguing that Scotland was the appropriate forum since the accident occurred there, all decedents were Scottish, and most evidence and witnesses were located in Scotland.
