The defendant, Pedrick, owned a parcel of land adjacent to the plaintiff, Pile. Pedrick planned to construct and operate a factory on his land, and, with that in mind, decided to erect a wall between his and Pile’s property. Pedrick consulted a surveyor and had a wall erected solely on what he believed to be his property, based on the surveyor’s findings. The surveyor erred, and, as a result, a fifty-foot strip of the wall encroached on Pile’s land. Pile sued.
