Linda J. Pierce obtained a Citibank Chase VISA account based on her own creditworthiness, while her husband Michael Pierce maintained several separate accounts with Citicorp Credit Services, Inc., a corporate affiliate of Citibank. When Michael Pierce became delinquent on his accounts, Citicorp closed all of his accounts and mistakenly included Linda Pierce’s account number in the closure notice sent only to Michael Pierce on January 11, 1991. Linda Pierce, who lived with her husband, never received her own notice and continued receiving regular statements and making payments until May 15, 1991, when a customer service representative informed her that her account had been closed and was linked to her husband’s delinquent accounts. Despite her telephone inquiry and a registered letter dated July 18, 1991 requesting written explanation, Citibank never provided specific reasons for the closure. Citibank reinstated her account on September 11, 1991, sending a letter congratulating her for returning her account to “good credit standing,” which she used until filing bankruptcy on May 18, 1992.
