On November 30, 1993, two-year-old Jerome Campbell obtained a Cricket disposable butane cigarette lighter belonging to his mother, Robyn Williams. The lighter had no child-resistant safety features. Jerome successfully operated the lighter and ignited linens in the home, starting a fire that killed Jerome, his mother Robyn, and another minor child. One child, Neil Williams, survived the fire. Gwendolyn Phillips, as administratrix of the three decedents’ estates and guardian of the surviving child, filed suit against the manufacturers and distributors of Cricket lighters, alleging design defects, negligence, breach of implied warranty of merchantability, and seeking punitive damages based on the absence of childproof features.
