Administrative Law Keyed to Seamon
Perry v. Sindermann
Citation:
408 U.S. 593 (1972)Facts
Robert Sindermann taught in the Texas state college system from 1959 to 1969, with his final four years at Odessa Junior College under a series of one-year contracts. During the 1968-1969 academic year, as president of the Texas Junior College Teachers Association, he testified before legislative committees and publicly disagreed with policies of the college’s Board of Regents, particularly advocating for the college’s elevation to four-year status, which the Regents opposed. In May 1969, the Board voted not to renew his contract, issuing a press release alleging insubordination but providing no official statement of reasons or opportunity for a hearing. Sindermann claimed the non-renewal was retaliation for his protected speech and that he had a property interest in continued employment based on the college’s Faculty Guide, which stated faculty members could feel they had “permanent tenure as long as teaching services are satisfactory,” and on Texas College and University System guidelines suggesting tenure for those employed as teachers for seven or more years.
