Thelma Perry received a credit card solicitation dated February 14, 2005, from First National Bank offering her a pre-approved Visa credit card with a $250 credit limit. The offer included a processing fee of $9, an acceptance fee of $119, an annual membership fee of $50, and a participation fee of $72 per year, totaling $184 in first-year fees. Perry did not authorize First National to access her consumer credit report. She alleged that First National used a consumer reporting agency to target individuals with poor credit or recent bankruptcy discharges for subprime credit offers. Perry claimed the disclosure notice was not “clear and conspicuous” as required by FCRA and that the offer was essentially worthless, constituting a sham rather than a legitimate firm offer of credit.
