Maria Perreira fell on snow while on the premises of Columbia Savings Bank. Takako was hurt by the Achor’s dog while Beninato was grooming the dog. At trial, the issue of whether the amount paid by the defendant’s insurance to cover medical costs should reduce the amount owed by each liable defendant came up.
Defendant argued their payments for medical bills should be reduced by the amount that plaintiff’s insurance paid her for those same bills because New Jersey had a statute in place on point to this issue. The plaintiff’s insurance, on the other hand, argued the statute did not supersede their common law right of subrogation or reimbursement for medical expenses.
