420 N.E.2d 40Facts
The first defendant, Olivo, was convicted of larceny for shoplifting when he was apprehended with wrenches concealed in his clothes just three feet from the store’s exit. The second defendant, Gasparik, was convicted of larceny for shoplifting when he was apprehended after removing the price tag and sensor from a jacket and attempted to wear the jacket out of the store. The third defendant, Spatzier, was convicted of larceny for shoplifting after he got into an altercation with a store owner who witnessed him take a book off the shelf and place it into his own case. All three defendants challenge their convictions.
