The District Attorney of Monterey County commenced an action on behalf of the People of California to restrain Eddie Lim and other defendants from continuing operation of a gambling establishment in Monterey. The complaint detailed how various gambling games were played and alleged that the gambling house constituted a public nuisance by encouraging idle and dissolute habits, disturbing the public peace, and corrupting public morals. The complaint further alleged that previous criminal prosecutions had proven ineffective and that equitable relief was necessary. The complaint specifically alleged that the gambling house drew together great numbers of disorderly persons, disturbed the public peace, brought together idle persons, cultivated dissolute habits, created traffic and fire hazards, and was thereby injurious to health, indecent and offensive to the senses, and impaired the free enjoyment of life and property. Defendants filed both general and special demurrers challenging the sufficiency of the complaint.
