On January 6, 1988, 16½-year-old Kafan Hana was arrested during a drug raid conducted by the Sterling Heights Police Department. He was charged with possession of more than 650 grams of a substance containing cocaine, delivery of more than 225 but less than 650 grams of a substance containing cocaine, conspiracy to induce a minor to commit a felony, and bribery of a public official. After arrest, Hana made numerous incriminating statements to police officers despite being advised of his Miranda rights and told not to speak without a parent or attorney present. These statements included boasts about his involvement in other drug deals, selling up to twenty kilograms of cocaine per month, and offering bribes to an officer. The probate court conducted a bifurcated waiver hearing. In phase I, the court found probable cause based on legally admissible evidence that did not include Hana’s statements. In phase II, the court permitted testimony about Hana’s statements from police officers and a court psychologist, ultimately waiving jurisdiction to adult criminal court.
