Defendant, Gregory Ezeonu, was charged with first degree rape and second degree rape of a thirteen year old girl. Ezeonu, a Nigerian national, claimed that the thirteen year old girl was his second wife and was offered to him by her parents. Ezeonu raised the defense that at the time of the alleged rape, the thirteen year old girl was given to him pursuant to Nigerian laws and tribal customs. He acknowledged, however, that he was already legally married under New York and Nigerian law at the time he entered into the second marriage. In 1992, Nigerian law recognized polygamy and New York law did not recognize marital rape.
