Facts
On December 22, 1973, Michael Geller was found shot to death in the bedroom of his Brooklyn apartment. The body, which had been riddled by bullets, was found lying face up on the floor. Detective Joseph Carrasquillo of the New York Police Department was assigned to investigate the homicide. When the officer arrived at the defendant’s place, the defendant answered the door. The defendant stated that, on the night of December 21, 1973, he, Bush and Geller had been out drinking. Geller several times demanded that Bush pay $100 towards the rent on the apartment. Bush rejected these demands. When Geller again pressed his demand for rent money, Bush drew his .38 caliber pistol, aimed at Geller and fired three times. After a few minutes, defendant fired five shots in the victim’s head and face.
