Ethical Problems in the Practice of Law Keyed to Lerman, 6th Ed.
People v. Belge
Citation:
376 N.Y.S.2d 771 (1975)Facts
Francis R. Belge was an attorney representing a client charged with murder. During the course of representation, his client confessed to additional murders and revealed the locations of the victims’ bodies. Belge personally verified this information by visiting the locations and finding the bodies but did not report his discoveries to authorities. When this became known, Belge was indicted for violating New York Public Health Law provisions requiring proper burial of human remains and reporting deaths that occur without medical attendance. Belge claimed that attorney-client privilege protected his actions in maintaining his client’s confidences, even though this meant not reporting the discovery of human remains.
