Defendant was charged with selling heroin on September 11, 1975. For three weeks prior to the sale, an agent (Cheryl) attempted to contact the defendant at his job at the Golden State Mental Health Detoxification Center. Cheryl finally spoke with the defendant and defendant told her to come to the Center. According to Cheryl, their conversation was brief but the defendant described the interaction as lasting more than an hour. The agent testified that the defendant had stated he had prior convictions and needed to be careful, but she was able to convince him she was not a cop. He then gave her a note to present to a dealer named Stella. Defendant testified that he finally agreed to meet with Cheryl because he was “fed up with her” and wanted her to quit calling him at the hospital for fear she would cause him to lose his job. After she persisted he then provided her with the note to introduce her to a source of heroin.
