People v. Barlow

Defendant Barlow provided a gun to his accomplices for use in a robbery of a grocery store. According to Barlow’s testimony, he later had a change of heart and attempted to withdraw from the conspiracy by telling his accomplices that he did not want to participate in the robbery. However, Barlow did not take back the gun he had provided, nor did he make any efforts to contact law enforcement or otherwise prevent the robbery from occurring. The robbery subsequently took place using the gun Barlow had supplied, resulting in his conviction as an accomplice to robbery in the first degree. Barlow appealed, arguing that his verbal renunciation of participation was sufficient to constitute withdrawal from the conspiracy.
