Facts
Chamberlain worked as a brakeman for Defendant. Plaintiff alleged that Chamberlain was operating a string of gondola cars and, as the result of negligence from other employees, a crash occurred which resulted in Chamberlain being struck and killed. All employees who were in a position to see asserted that no crash occurred. One witness, Bainbridge, claims that he saw Chamberlain riding at the rear of the string of cars, looked away, heard a loud crash, and looked up to see Chamberlain no longer in sight.
