The National Institute of Health (NIH) solicited bids for a construction project to renovate one of their buildings. Plaintiff, in advance of submitting a bid for that contract, solicited bids to subcontract out portions of the construction job. On August 5, 1993 defendant submitted an $898,000 bid to plaintiff for HVAC and plaintiff bid on the NIH contract. On September 1, 1993, plaintiff formally accepted defendant’s bid. Later that day defendant withdrew its bid. On September 28, plaintiff was awarded the main contract and had to hire a different subcontractor for $930,000 for that portion of the work. Plaintiff sued defendant for the difference.
