The petitioners included eyebrow threaders and threading salon owners who challenged Texas’s cosmetology licensing scheme as applied to eyebrow threading. Threading is a grooming practice involving removal of eyebrow hair using cotton thread. In 2011, Texas categorized threading as cosmetology practice. To legally practice threading, individuals must obtain at least an esthetician license requiring 750 hours of instruction in Commission-approved training programs and passing state examinations. The curriculum includes subjects such as facial treatments (225 hours), anatomy (90 hours), electricity and machines (75 hours), makeup (75 hours), chemistry (50 hours), orientation and laws (50 hours), client care (50 hours), sanitation and safety (40 hours), management (35 hours), superfluous hair removal (25 hours), aromatherapy (15 hours), nutrition (10 hours), and color psychology (10 hours). Threading techniques are not required curriculum, and fewer than ten of 389 approved schools teach threading. The State conceded that over 320 of the 750 required hours are unrelated to threading practice, though the Threaders argued as many as 710 hours were irrelevant.
