Facts
Parvi, along with another individual, was picked up by the City of Kingston police following an altercation. The officers later described plaintiff as exhibiting signs that he had been drinking, but did not provide details. According to the police, standard operating procedure when they encountered an individual in this state who had no place to go, was to drive them outside of the city limits to abandoned golf course. The officers then drove to the golf course, ignoring the men’s pleas to be let off elsewhere, and left the two to sober up. Parvi, having little idea where he had been taken, attempted to discern his location by wandering onto a nearby road, which happened to be a busy freeway. At approximately 10 pm the two men were struck by a car, Parvi was severely injured, the other man was killed.
