On August 6, 1965, plaintiff Shirley MacLaine Parker contracted with defendant Twentieth Century-Fox Film Corporation to play the female lead in “Bloomer Girl,” a musical production to be filmed in California, with guaranteed compensation of $750,000 for 14 weeks of work commencing May 23, 1966. The contract included approval rights for director, screenplay, and dance director. In April 1966, defendant decided not to produce “Bloomer Girl” and notified plaintiff of the breach. Simultaneously, defendant offered plaintiff the lead role in “Big Country, Big Man,” a dramatic western to be filmed in Australia with identical compensation but eliminating or substantially impairing the director and screenplay approval rights contained in the original contract. Plaintiff was given one week to accept the substitute offer, which she declined. Plaintiff then filed suit seeking recovery of the guaranteed compensation under the breached contract.
