In May 1933, Oregon’s Department of Agriculture issued an order establishing standard containers for fruits and vegetables, including specific dimensions for hallocks to be used for raspberries and strawberries. The plaintiff, Pacific States Box & Basket Company, manufactured a different type of container called “tin-top” or “metal rim” cups, which differed from hallocks in shape and construction. The tin-top containers had sloping sides and a flat bottom, unlike hallocks which had perpendicular sides and a raised bottom. The plaintiff had sold these containers to Oregon dealers for years. The order effectively prevented the plaintiff’s containers from being used in Oregon for raspberries and strawberries. The plaintiff claimed it had no facilities for manufacturing hallocks and that it would be impracticable to install the necessary machinery and obtain appropriate supplies. The plaintiff challenged the order as violating due process, equal protection, and the commerce clause of the U.S. Constitution.
