Evidence Keyed to Best
Olden v. Kentucky
Citation:
488 U.S. 227 (1988).Facts
Olden and Matthews met and a bar, which eventually lead to sexual intercourse. Olden claimed it was consensual, while Matthews alleged she had been kidnapped, raped, and forcibly sodomized. Olden attempted to introduce evidence that Matthews was dating and living with his half-brother (Russell), who was African-American, to show Matthews had a motive to provide inaccurate information due to fear of retaliation. The trial court excluded such evidence, finding evidence Matthews (a white woman) dating an African-American would unfairly prejudice her in the eyes of the jury.
