Petitioner Johnny Lynn Old Chief was arrested in 1993 after a fracas involving at least one gunshot. He was charged with assault with a dangerous weapon. Old Chief was charged with having been convicted of an earlier assault causing serious bodily injury. Before trial, he requested that the trial court order the government not to mention any detail regarding the prior conviction. Old Chief contended that the Federal Rules of Evidence made the name and nature of his prior offense unfairly prejudicial, since the jury was likely to generalize his earlier bad act into bad character.
