Respondents’ husbands worked on drilling platforms in the Gulf of Mexico off the coast of Louisiana. On August 6, 1980, they were killed when a helicopter owned and operated by petitioner Air Logistics crashed while transporting them from an offshore drilling platform to Houma, Louisiana. The crash occurred approximately 35 miles off the coast of Louisiana, well beyond the three-mile territorial limit. Respondents filed wrongful death suits in federal court, raising claims under DOHSA, OCSLA, and Louisiana law. They sought nonpecuniary damages (loss of society) available under Louisiana’s wrongful death statute but not under DOHSA, which limits recovery to pecuniary losses. The district court ruled that DOHSA provided the exclusive remedy and dismissed the state law claims. The Fifth Circuit reversed, holding that § 7 of DOHSA preserved state wrongful death remedies even on the high seas.
