Paul Minihane (Defendant) purchased two-luxury seats from NPS, LLC (Plaintiff), the developer of Gillette Stadium for the New England Patriots football team. The agreement was a ten-year license, and called for Minihane to pay $3,750 annually for each of the ten football seasons. Minihane failed to pay for the second season. The agreement contained an acceleration clause which required him to pay the remaining balance for the upcoming years on the license. Minihane refused to pay this balance, and NPS brought suit to recover the full amount owed.
