On April 23, 2011, Victor Norwood and several friends went to the AMC Lowes Roosevelt Field 8 movie theater. The group was causing a disturbance, hitting glass doors, and creating a ruckus. Theater manager Eric Adams confronted them at the concession stand, leading to a verbal dispute. Adams brandished a collapsible baton during the confrontation. After the group received ticket refunds and left, Adams retrieved an airsoft pellet gun from his vehicle and returned to confront them outside the theater entrance. The plaintiff alleged Adams pointed the gun at him, causing him and his friends to scatter. Adams was subsequently arrested. The plaintiff sued alleging intentional infliction of emotional distress, assault and battery, vicarious liability, and negligent hiring and supervision.
