On February 3, 1996, Andrew Block purchased a 1988 Chevrolet Cavalier from North Shore Auto Sales and entered into a retail installment contract to finance the purchase. North Shore included a $35 charge for vendor’s single-interest insurance in the “Amount Financed” section of the contract and charged the maximum legal interest rate of 25 percent per annum under R.C. 1317.061. North Shore assigned the contract to CNAC. The installment contract failed to inform Block that he could purchase VSI insurance from another source, and the contract marked the space for disclosure of VSI insurance premium as “N/A” (not applicable), though the second page listed “Amount Paid to Insurance Companies” as $35. North Shore had purchased VSI insurance from Interstate Company. Block filed counterclaims alleging that the $35 VSI charge was actually an undisclosed finance charge that, when added to the stated interest rate, exceeded the 25 percent maximum, violating RISA’s usury provision. Block sought and obtained class certification for similarly situated consumers.
