North American Cold Storage Company operated a cold storage facility in Chicago where it stored food products for customers as a bailee for hire. On October 2, 1906, city health officials demanded that the company surrender 47 barrels of poultry for destruction, claiming the poultry had become “putrid, decayed, poisonous or infected” and thus unsafe for human consumption. The company refused, contending that the poultry was wholesome and that the ordinance authorizing seizure without judicial determination violated the Fourteenth Amendment’s due process clause. After the company’s refusal, officials threatened to shut down its business operations until it complied. The company sought an injunction, arguing that the poultry would remain wholesome in cold storage for three months, providing ample time for a hearing before any destruction.
