Kevin Nguyen (plaintiff) purchased two Hewlett-Packard Touchpads on the Barnes & Noble, Inc. (defendant) website. The Touchpad was intended to be a competitor to Apple’s iPad but was ultimately unsuccessful. Barnes & Noble ultimately did a nationwide liquidation of the product. Because of an unexpected high demand of the liquidated Touchpad, Nguyen’s purchase of two units was cancelled. Nguyen sued Barnes & Noble on behalf of himself and other consumers whose Touchpad orders had been cancelled. Barnes & Noble moved to compel arbitration, arguing that Nguyen was bound by the arbitration agreement in the Barnes & Noble website’s Terms of Use.
