Newsome v. Western Union Telegraph Co.

T.J. Newsome (plaintiff) transmitted a telegram via Western Union Telegraph (“Western Union”) (defendant) for an order of four gallons of corn whiskey. Newsome ordered the whiskey as part of an agreement with his raft hands, who were preparing to construct rafts during a heavy water flow. The raft hands refused to go to water without the whiskey. Unfortunately, the signature on the delivered telegram was transcribed as “T.J. Sessons” instead of “T.J. Newsom.” The whiskey was never delivered and Newsome’s raft hands never went out into the water. Newsome brought suit against Western Union to recover lost profits resulting from the mistake in the telegram.
