National Labor Relations Board v. Sears, Roebuck & Co.
Citation:
421 U.S. 132 (1975)Facts
Sears, Roebuck & Co. requested that the NLRB General Counsel disclose all Advice and Appeals Memoranda issued within the previous five years on specific labor law subjects, including multi-employer bargaining withdrawals. The General Counsel initially refused, claiming the documents were exempt from disclosure under FOIA Exemption 5 as internal agency memoranda. After a change in leadership, the General Counsel offered to disclose some memoranda in closed cases but maintained that many documents remained exempt. The NLRB’s process for handling unfair labor practice charges begins with a charge filed with a Regional Director, who may seek advice from the General Counsel’s Advice Branch before deciding whether to issue a complaint. If the Regional Director decides not to issue a complaint, the charging party may appeal to the General Counsel’s Office, which issues Appeals Memoranda explaining its decisions. These memoranda serve different functions depending on whether they direct filing a complaint or dismissing a charge.
