On September 30, 1991, the defendant and the victim completed their shift on an oil rig and began drinking. While at the Cowboy Bar, the two began arguing about another coworker. Defendant then left the bar, and went to Pete’s Bar where he ate a pizza, drank, and then drove home at approximately 10:30 p.m. Around 11:00 p.m., the victim had his cousin drive him to the defendant’s home to get his work clothes out of defendant’s truck. Defendant began shooting when he saw the car coming down the driveway. The victim exited the vehicle and identified himself. The defendant told the victim to get off off his property and fired shots toward the victim’s feet. The victim again identified himself and the defendant walked toward him till they were six feet apart. Defendant told him to leave and the victim turned around and began walking back to the car. The defendant fired three or four more shots causing a bullet to ricochet off a rock striking the victim’s femoral artery in his thigh. The victim got back in the car and his cousin drove him to Pete’s Bar, two miles away. The cousin and a bartender attempted to stop the bleeding until an ambulance arrived 30 minutes later. The victim appeared to be in good shape, but lost consciousness shortly after reaching the hospital due to blood loss and was unable to be resuscitated.
