In the 1960s, the Murrs’ parents purchased two adjacent lots (Lots E and F) along the St. Croix River in Wisconsin. Each lot was separately deeded but later came under common ownership when the parents transferred both lots to their children in the 1990s. A local zoning ordinance, enacted in 1975, prohibited development or separate sale of adjacent substandard lots under common ownership, effectively merging the lots for regulatory purposes. When the Murr siblings sought to sell Lot E separately to fund improvements on Lot F, they discovered the regulatory restriction. They filed suit, claiming that the merger provision constituted a regulatory taking of their property without just compensation.
