Jack Ginsberg, a 65-year-old production manager with 40 years of experience in the ladies ready-to-wear industry, entered into a three-year employment contract with the defendants beginning September 1, 1965, at a salary of $700 per week. On October 16, 1965, Morty Freedman discharged Ginsberg and replaced him with Phil Clemente. Ginsberg subsequently found employment with Justin McCarty Company at $400 per week, which lasted for 34 weeks until July 18, 1966. When Justin McCarty wanted Ginsberg to train his replacement at a lower salary without offering job security, Ginsberg left that position. Despite writing over 150 letters, placing advertisements, attending industry events, and spending over $1,000 in his job search, Ginsberg was unable to secure another suitable position in the industry.
