Facts
Nathaniel Mosley and nine other individuals brought an action against General Motors (both its Chevrolet and Fisher Body divisions) and their union, alleging violations of Title VII and 42 U.S.C. § 1981. Each plaintiff had previously filed charges with the EEOC, which found reasonable cause that unlawful employment practices had occurred. The plaintiffs alleged various discriminatory practices including discrimination in promotions, retaliation against employees who protested unlawful actions, failure to hire based on race and sex, discriminatory discharge practices, and discrimination in granting relief time. The plaintiffs sought to proceed both individually and as class representatives. The district court ordered that the ten individual counts be severed into separate actions, reasoning that the claims presented a variety of issues with little relationship to one another beyond having the same defendants.
