Facts
John Moore (Plaintiff) was treated by the Regents of the University of California, Dr. Golde, and Shirley Quan (Defendants) for hairy cell leukemia, which involved the extraction of many bodily tissues. The defendants used many of his extracted bodily tissues to develop highly profitable medical products. The defendants knew that Moore’s tissues were unique and extremely valuable, but they did not inform the plaintiff of this or that they would be using his tissues for research before they obtained his consent for removal. The defendants used genetic engineering to develop a cell line from the plaintiff’s cells, obtained a patent for it, and entered into several commercial agreements to rights for the cell line and its related products. Moore sued the defendants for using his cells without his permission.
