Moffett v. State
Facts
Early one morning, Deanna Moffett (Defendant) and Bobby McPherson, age fourteen, awakened Linda Exner who was asleep alone in her apartment. Defendant tied Exner up while McPherson held a knife to her throat. Defendant then untied Exner’s hands only and forced Exner to write, in her own handwriting, a “suicide note” that Defendant had written days earlier. Defendant then told Exner that she was going to make her take some pills. Exner wrote about one line of the note and then struggled with Defendant and McPherson before escaping. Defendant and McPherson fled the apartment and returned to the residence of Ed McPherson where they were arrested. After arriving at Exner’s apartment, the police found a bottle of wine, a switchblade knife, a flashlight, a bottle of pills, another knife, a short length of hemp rope, and the note. Defendant was charged with attempted murder and burglary. At trial, a pathologist and toxicologist testified that the pills were sleeping pills and that a high dosage could have been lethal. Defendant was convicted and she appealed.
