The defendant was charged and convicted of both an “armed criminal action” and first-degree robbery. He was sentenced to concurrent terms for each offense. The Missouri Court of Appeals reversed, finding that it violated the Double Jeopardy Clause, as the Supreme Court of Missouri previously held that that under the Blockburger test, armed criminal action and any underlying offense are the “same offense.”
