The Millbrook Hunt, Inc. (the plaintiff) is an organization dedicated to the preservation of traditional fox hunting. Edgar Smith (the defendant) is the owner of a 285 acre property, upon which the former owner of the land granted permission to the plaintiff in 1987 to use the land for fox hunting for a term of 75 years “unless terminated sooner pursuant to the terms of the lease or pursuant to law.” In 1995, the defendant ejected members of the plaintiff’s organization from his land while they were performing maintenance on their fox hunting trails.
