Milanowicz v. The Raymond Corporation

On August 20, 1997, Michael Milanowicz, an employee at General Motors Service Parts Distribution Facility in Bensalem, Pennsylvania, injured his hand while laterally adjusting the forks on a lift truck manufactured by Raymond Corporation. The lift truck’s forks were mounted on pivots and secured by pins that fit into holes on the carriage. To adjust the forks laterally, an operator would pivot each fork upward to disengage the pin, shift the fork to the desired position, and then swing it down to re-engage the pin. While attempting to manually manipulate a fork that had not properly re-engaged, Milanowicz’s hand slipped behind the fork on grease, and when the pin found the hole and came down, it severed his finger. The original 48″ forks on the lift truck had been replaced by 60″ forks manufactured by Dyson Corp., which did not conform to Raymond’s design specifications. The original forks featured chamfered pins designed to facilitate proper pin alignment, while the replacement forks had square shoulders with no chamfer.
